Terms and Conditions

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements and agree to be bound by them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at ypierce@thepaintpalate.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

1. General Terms

These Terms apply to all services offered by The Paint Palate LLC including private paint parties, kids art camps, public painting events, ticketed events, pre-drawn canvas orders and website use. By accessing or using our website or services, you agree to comply with and be legally bound by these Terms.

2. Registration Booking and Payment

Full payment is required at the time of registration, order or booking. Services are not confirmed until payment is processed. Pre-drawn canvas orders must be fully prepaid.

3. Refund and Cancellation Policy

All private events hosted through The Paint Palate are subject to the following refund and cancellation terms. By booking a private paint party, the host agrees to these policies in full.

Pay-Per-Guest Reservations
A non-refundable reservation fee of 125 is required to secure your private event date. This fee is applied toward the total event balance.
The final guest count and remaining balance are due 7 days prior to the event.
If the host cancels more than 7 days before the event, no additional charges will apply beyond the non-refundable reservation fee.
If the host cancels within 7 days of the event, the 125 fee is forfeited. Any guests who have prepaid individually will receive a full refund.
If The Paint Palate cancels due to an emergency or unforeseen circumstances, the host and prepaid guests will receive a full refund including the reservation fee or the option to reschedule.

Party Package Bookings Package 1 and Package 2
Full payment is due at the time of booking.
All party packages are non-refundable regardless of cancellation reason or guest attendance.
Hosts may reschedule once within 60 days of the original event date subject to availability.

Rescheduling Policy
Events may be rescheduled one time at no charge if the request is made at least 7 days in advance of the event.

Kids Art Camps
Art camp registrations are non-refundable including absences due to illness, injury, vacation, scheduling conflicts or dismissal due to behavior. Camp supplies, materials and staffing are prepared in advance based on enrollment. Please confirm your availability before completing registration as no credits or transfers will be issued.

Pre-Drawn Canvas Orders
All sales are final once an order is placed. No refunds or exchanges on custom orders.

Ticketed Events
Tickets are non-refundable. Tickets may be transferred to another guest with at least 24-hour notice unless otherwise stated in the event description. If The Paint Palate cancels an event, guests may choose a refund, credit or rescheduling option.

4. Photography / Videography  No Recording Policy

For the comfort, safety and privacy of all guests, photography and video recording during events may be limited or prohibited unless otherwise stated. Guests may not photograph or record other participants, instructors or staff without their consent.

Unauthorized photography or video recording may result in removal from the event without refund.

The Paint Palate may take photographs or videos during events for promotional, marketing or documentation purposes. By attending an event, guests grant permission for The Paint Palate to use such images or recordings unless written notice is provided prior to the event.

5. Behavior and Safety Expectations

Respectful, safe behavior is required. Disruptive behavior, horseplay or unsafe conduct may result in dismissal without refund.

6. Assumption of Risk and Liability Waiver

Participants assume all risks associated with art activities. The Paint Palate is not responsible for injuries, damages or stained clothing. By participating, you waive all claims against The Paint Palate LLC, its owners and staff.

7. Unattended Children Policy

Children must be supervised outside of structured programs. A late pickup fee of 15 will be charged for late pickups after 15 minutes and 1 per minute thereafter for kids classes organized by the studio.

8. Alcohol Policy

Some events hosted by The Paint Palate may allow guests to bring and consume alcoholic beverages BYOB. Alcohol is permitted only at events where it is explicitly stated in the event description.

Alcohol consumption is permitted only for guests who are at least twenty-one (21) years old and who can present valid government-issued identification upon request.

Guests are expected to consume alcohol responsibly. Excessive intoxication, disruptive behavior or failure to comply with staff instructions will not be tolerated and may result in removal from the event without refund.

The Paint Palate reserves the right to refuse entry, refuse service or remove any guest who appears intoxicated or who violates this policy.

The Paint Palate is not responsible for the actions, behavior or safety of guests who choose to consume alcohol. By attending an event where alcohol is permitted, guests assume all responsibility and liability related to alcohol consumption.

9. Disclaimer

The Paint Palate provides art instruction, materials and experiences intended for educational, entertainment and recreational purposes only. Results may vary. We do not guarantee artistic outcomes, skill levels or specific personal experiences. Participation is voluntary and undertaken at your own risk. The Paint Palate is not responsible for allergic reactions to provided materials, dissatisfaction with creative outcomes or any injuries sustained during activities.

10. Force Majeure Uncontrollable Events

The Paint Palate is not liable for cancellations, delays or failure to perform due to acts of God, weather events, health emergencies or other uncontrollable events. Refunds, credits or rescheduling options will be offered where possible.

11. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at ypierce@thepaintpalate.com.

12. Purchases

If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to your credit or debit card number, the expiration date of your card, your billing address and your shipping information.

You represent and warrant that (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase and (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

13. Contests Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

14. Content

Content found on or through this Service are the property of The Paint Palate LLC or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

15. Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:
0.1. In any way that violates any applicable national or international law or regulation.
0.2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
0.3. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter”, “spam”, or any other similar solicitation.
0.4. To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity

16. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

17. No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

18. Accounts

When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or account. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

19. Intellectual Property

Service and its original content (excluding content provided by users), features, and functionality are the exclusive property of The Paint Palate LLC and its licensors and are protected by copyright, trademark, and other laws.

20. Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to claims that content posted on Service infringes copyright or other intellectual property rights.

21. DMCA Notice and Procedure

Copyright infringement claims should be submitted to

and must include all information required under the Digital Millennium Copyright Act (DMCA).

22. Error Reporting and Feedback

You may provide feedback or suggestions. You agree that we may use such feedback without restriction or compensation.

23. Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by The Paint Palate LLC. We assume no responsibility for their content, policies, or practices.

24. Disclaimer Of Warranty

Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

25. Limitation Of Liability

To the fullest extent permitted by law, The Paint Palate LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages. Liability, if any, shall be limited to the amount paid for the service.

26. Termination

We may terminate or suspend access to Service immediately, without prior notice, for any reason, including breach of these Terms.

27. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina.

28. Changes To Service

We reserve the right to withdraw or amend our Service at any time without notice.

29. Amendments To Terms

We may amend these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

30. Waiver And Severability

No waiver of any term shall be deemed a further or continuing waiver. If any provision is held invalid, the remaining provisions remain in effect.

31. Acknowledgement

By using the Service, you acknowledge that you have read and agree to be bound by these Terms.
